Please read the following Terms and Conditions of Use (hereinafter and indiscriminately, “Terms”) of https://uruguay.uy/ (hereinafter and indiscriminately, “Portal”) carefully.

The Portal is part of the initiative managed by the Digital Uruguay opens up to the world committee formed by the Presidency of the Republic, Ministry of Foreign Affairs, Ministry of Livestock, Agriculture and Fisheries, Ministry of Tourism, Institute for the Promotion of Investments and Exports of Goods and Services (Uruguay XXI), Agency for e-Government and the Information and Knowledge Society (Agesic), created by virtue of article 79 of Law no. 20.075 of November 3, 2022. Its first version involved the Ministry of Industry, Energy and Mining, and the Uruguayan Chamber of Information Technologies (CUTI).

Without prejudice to the foregoing, AGESIC shall be responsible for the maintenance of the Portal and the development of its content, pursuant to the guidelines indicated by the entities participating in its design.

The use of the Portal, its services, or content by the user implies the full and unreserved acceptance of all provisions contained in the version published at the time the user accesses the site.

Provided that the Terms may be modified from time to time by AGESIC, it is recommended that users carefully read them each time they intend to use the site. The new versions shall become effective upon their publication in the Portal.

1. Purpose of the Portal

The website https://uruguay.uy/ is a digital entrance door that displays what Uruguay has to offer. It aims to provide quality information not only to foreigners interested in getting to know our country but also to Uruguayans promoting it beyond borders.

2. User Status

For the purposes of these Terms, “user” shall refer to any individual, legal or public entity, whether governmental or not, entering the site to visit, explore and obtain information, or using the Portal and its content, directly or through an IT app.

3. Conditions of Portal Access and Use

The use of the Portal is free for the users, who agree to use it in compliance with current national regulations, good customs, and public order, undertaking not to cause damage to Agesic, the members of the Committee, other users, or third parties.

Based on the above, the users shall refrain from using the Portal, its content, or any of its services with unlawful purposes or effects, prohibited in these Terms, in technical or legal standards, detrimental to the rights and interests of the Uruguayan Government, of other users or third parties, or which could otherwise harm, disable, overload, spoil, or prevent the regular use of the Portal, its services or content, as well as of any IT device of Agesic, others users or third-parties.

The user may use all the contents of the site freely, with the exception of the images and those features specifically indicated in these terms and conditions. This does not apply to the content of the sites to which users access through provided links.

The images included in this website belong to Aguaclara stock library (aguaclara.com.uy), which provided them for use for a given period of time and through an effective contract by means of an agreement with Uruguay XXI, so its use shall not be authorized in any case. The site also features photographs that belong to the Stock Library of Uruguay´s Ministry of Tourism, so it is required to expressly request authorization before its use.

The featured videos were developed by several governmental entities to promote certain regions of the country, as well as by chambers or institutions that group several sectors of national production, authorizing its free use, except as otherwise expressly provided.

4. Obligations of the Users

The User agrees to the following:

Not to harm, disable or spoil the IT systems which support the Portal, those of Agesic, of other users, or of third parties, nor the content incorporated into and/or stored in them.

Not to modify the abovementioned systems in any way and, therefore, not to use versions of modified systems with the purpose of obtaining unauthorized access to any content and/or services of the site.

Not to interfere nor interrupt the access and use of the Portal, servers, or networks connected to this or default on the requirements, procedures, and regulations of network connection policy.

Agesic may act, through the means it deems relevant and appropriate, against any use of the Portal by users or third-parties which is contrary to these Terms, violates or infringes intellectual property rights, as well as any other rights thereof, of other users or of third-parties.

Agesic reserves the right to amend, at any time and without prior notice, the display, settings, content, and services of the Portal https://uruguay.uy/, being entitled to interrupt, disable, and/or cancel any of its content and/or services, built or incorporated into it, without expressing cause and without responsibility.

5. Intellectual Property

All brands, trademarks, or distinctive signs of any kind appearing on the website from time to time are owned by the Uruguayan government, or by third parties, and in no case may the use or access to the website be construed as conferring the user any right on the mentioned brands, trademarks or distinctive signs of any nature.

In connection with the other content of the Portal, the user may use it in the conditions prescribed by these terms and conditions, considering in particular provisions of clause 3.

6. Responsibility of the Owner of the Portal

The accuracy, entirety, and timeliness of the content published in the Portal shall be the exclusive responsibility of the entity which provides it.

Agesic shall bear no responsibility for the damages of any nature whatsoever that may arise in connection with the lack of availability or continuity in the operation of the Portal, services, or content, in particular, by way of illustration, with its reliability, with failure in the access to the different websites or to those from which the services or content are provided.

Scheduled interruptions shall be announced.

7. Links to External Sites or Portals.

The Portal may contain linking technical devices (such as links, banners, buttons) which allow access to websites belonging to third parties, with the sole purpose of facilitating the search and access to other sites and/or content available on the Internet for the users.

The links to other websites, services, or content, do not imply its approval, in any way whatsoever, so Agesic on its merit, disclaims all contractual, legal, or other responsibility that may arise from, by way of example, the accuracy and use of the linked services and/or content.

8. Duration and Termination

The Portal, its services, and its content have an indefinite duration. Without prejudice to the foregoing, it may suspend on a temporary or final basis, in whole or in part, by Agesic without expressing cause and without responsibility, when it deems the necessary conditions for its continuity are not in place.

9. Protection of Personal Data

All personal data provided within the frame of the use of the Portal shall be processed by Agesic pursuant to provisions of Law no. 18,331 of August 11th, 2008, and its regulatory decree number 414/2009 of August 31st, 2009 and in accordance with the privacy policy of the site.

Agesic may use cookies for the use of the Portal. However, users may adjust their browsers ´settings to be notified when receiving cookies and prevent their storage in the hard drive, when considering it appropriate.

10. Removal and Suspension of the Services

Agesic may remove or suspend, at any time and without the need of prior notice, the provision of the services of the Portal for those users that fail to comply with the provisions of these Terms.

11. Applicable Law and Competent Jurisdiction

Any dispute arising from the application and interpretation of these Terms of Use shall be resolved by the judges and ordinary courts of the city of Montevideo, Oriental Republic of Uruguay.

The law of the Oriental Republic of Uruguay shall apply.

12. Procedure to Report Content

In case of erroneous, incomplete, or outdated content, which infringes intellectual property rights, or upon any irregular situation, in fact, or by law, the user may contact us via email at contact form.
